What is a separation agreement and why do I need one?
A separation agreement is a written document setting out how you and your partner divide property and debt, arrange parenting, and handle support. It records the terms you agree. Hailee explains their legal effect and the signing steps for your situation.
Can we modify the agreement later?
Yes. Your agreement includes procedures for modification if circumstances change significantly, income, parenting arrangements, and so on. Most changes are made by written agreement between the two of you. Where a court order is already in place, changing it usually means going back to the court.
Is your service completely virtual?
Yes. We serve clients throughout Saskatchewan entirely online, video calls, email and phone. You work from home, at your convenience, wherever you are in the province.
What gives a property agreement legal effect?
Its effect depends on the terms, circumstances and statutory requirements. Hailee explains the steps that apply to your document. For an interspousal property agreement under section 38 of The Family Property Act, each spouse must make the required acknowledgment before a lawyer who does not represent the other spouse and has not taken the other spouse's acknowledgment. Peace can advise and draft within its licensed scope; we coordinate the required separate lawyers for those acknowledgments.
What if our matter becomes contested?
Unresolved terms do not by themselves rule out advice or negotiation. Hailee assesses whether the work is appropriate and safe within her licensed scope. If courtroom representation or other work outside that scope is needed, she explains the appropriate next step.
Do we both need separate lawyers?
Both parties are always encouraged to obtain independent legal advice before signing any agreement. We are happy to provide independent legal advice for one party. The other party should obtain independent legal advice from another family law professional. Each person should understand their own rights and obligations before signing. Is a separation agreement filed with the court?
No. A separation agreement is a private, written contract between you and your partner, it is not filed with the court. Drafting, finalizing, and signing are included in our fixed fee. (Court filing applies only if you later proceed to a divorce.)
Can a separation agreement be done before a divorce?
Yes. Many couples put a separation agreement in place first to settle terms, then formalize the divorce later. The agreement can stand on its own or roll into your divorce documents when you're ready.
